DWI Blood & Breath Tests

If you are in an auto accident or legally stopped for a traffic offense, police officers will immediately evaluate whether or not you are impaired. Impairment could be due to alcohol, illegal drugs, prescription drugs, or any combination. If the officer suspects you are impaired, a DWI investigation will ensue. This usually leads to an officer requesting a specimen of your blood (less frequently the request will be for your breath). In most East Texas counties, if you refuse to give blood/breath you will be compelled to provide it. When a judge signs a search warrant for your blood, a blood draw will occur. Resisting a blood draw could lead to additional charges, depending on your actions.
